1. About us & these terms

This website and the Con Leche loyalty and ordering service are operated by , registration number , trading from , Pretoria, South Africa (“Con Leche”, “we”, “us”).

We sell and prepare fresh drinks and food items for collection. By creating an account, placing an order, or using this site, you agree to these Terms & Conditions and to our Privacy Policy. If you don't agree, please don't use the service.

2. Eligibility & accounts

  • Creating an account is free. There's no charge to register or to join the loyalty programme.
  • You must be 18 years or older to create an account and place orders.
  • You can sign up with an email and password, or with “Continue with Google”. If you use Google, we receive your name, email, profile photo, and Google account ID (never your password) — see the Privacy Policy for detail, and you can disconnect Google at any time.
  • You must provide accurate information and keep your login details confidential. You're responsible for activity under your account.
  • One account per person. We may suspend or close accounts that are used fraudulently or that breach these terms.
  • You can delete your account and personal information at any time on request or from your account settings (see the Privacy Policy).

3. Placing an order

When you place an order, you're making an offer to buy. Your order is only confirmed once we accept it and you receive a confirmation (on-screen and/or by email/WhatsApp). Where you pay online, payment being accepted by the gateway and your order being confirmed by us happen together — if payment isn't completed, no contract is formed and preparation won't begin.

We prepare orders on a first-come basis during trading hours. We may decline or cancel an order (with a full refund of anything paid) if an item is out of stock, if there's an obvious pricing error, or if we can't safely fulfil it.

4. Menu, pricing & availability

  • All prices are in South African Rand (ZAR / R) and are inclusive of VAT. No hidden service fees are added at checkout.
  • We may change menu items and prices at any time. The price that applies is the one shown at the moment you place your order.
  • Items are subject to availability and are prepared while stocks last. If an ingredient runs out, we may substitute a like-for-like ingredient of equal or better quality, or contact you / offer a refund for that item.
  • Some items are only available on certain days. Cake is baked for the weekend and is normally only available then, so a cake order — or a loyalty reward you'd like to spend on cake — can only be fulfilled on a day we've actually baked it. Where an item is day-limited, we'll say so on the menu.
  • Photos are for illustration; the actual item may vary slightly.

Because Con Leche is collection-only, there are no delivery fees or dynamic delivery charges at checkout. If delivery launches, delivery charges will be shown clearly before you pay.

5. Payment

Online payments are processed securely by our third-party payment gateway, Ozow. You enter your payment details on Ozow's secure page — we never see or store your full card or banking details. Payment must be completed for an order to be confirmed. If a payment fails or is reversed, the order will not proceed.

6. Collection & uncollected orders

  • Orders are prepared for collection at . We'll let you know when your order is ready.
  • Because food is freshly prepared, collection times are a best-effort estimate and can be affected by how busy the kitchen is.
  • If you don't collect a confirmed, paid order within minutes of it being ready (or by close of trading), we may not be able to keep it fresh. Uncollected food that has spoiled cannot be remade free of charge, as it was prepared and held for you as ordered.

7. Delivery

Con Leche does not offer delivery at this time — all orders are collection only. There is no delivery radius, delivery window, or driver hand-over to describe. If delivery is introduced, this section (and the Privacy Policy) will be updated to cover delivery areas, timing, charges, and what happens if you're unreachable at drop-off.

8. Allergens & dietary needs

If you have a severe allergy, please tell us before ordering using the dietary-notes field or by contacting us directly, and confirm with our staff at collection. Our menu items may contain, or come into contact with, common allergens including milk, nuts, soya, eggs, wheat/gluten, and others.

We prepare food in a shared space (a coffee truck / small kitchen). While we take reasonable care to handle your order safely, we cannot guarantee that any item is completely free from a given allergen, and we cannot fully exclude the risk of cross-contamination. To the extent the law allows, we're not liable for an allergic reaction where you did not tell us about the allergy, or where cross-contamination occurs despite our reasonable care. If in doubt, please don't order the item.

⚠ Action required Allergen wording is health-and-safety sensitive and the Consumer Protection Act limits how far you can exclude liability. Have a lawyer confirm this clause before publishing.

9. Cancellations, refunds & issues

9.1. Cancelling an order

Because orders are freshly prepared, you can cancel for a full refund only up until we begin preparing your order. Once preparation has started, the order can't be cancelled or refunded. If you need to cancel, contact us as soon as possible on the number below.

9.2. Incorrect, missing, or damaged items

If an item is incorrect, missing, or damaged due to our error, we'll replace the item free of charge (or refund it if a replacement isn't practical). Please raise it with us at collection or as soon as reasonably possible, with your order reference, so we can put it right. This does not affect your rights under the Consumer Protection Act.

10. Loyalty programme — Pase de Café

Our loyalty programme rewards you for buying drinks. Membership is free — there's no charge to register or to join, and you need a registered account to earn stamps or receive rewards, other than the phone-number tracking described in 10.13, which needs no account at all.

10.1. Earning loyalty stamps

  • You receive one digital loyalty stamp for every qualifying, paid beverage you buy. How it's credited depends on how you order:
    • Ordered through the app: your stamp is credited automatically the moment payment is confirmed — online payment, or cash marked paid at pickup. No QR scan is needed at collection.
    • Ordered at the counter: your stamp is credited when a staff member scans your QR code at the point of purchase.
  • Only participating beverages qualify. Complimentary, fully discounted, refunded, cancelled, or otherwise non-qualifying transactions don't generate a stamp.

10.2. The reward cycle

Stamps run on a repeating 10-stamp cycle:

  • Stamps 1–4: no reward.
  • Stamp 5: a randomly assigned product discount (see 10.3).
  • Stamps 6–9: no reward.
  • Stamp 10: a free qualifying beverage (see 10.5) — separate from, and not counted as, the stamp 5 discount.

The cycle then resets and begins again at stamp 1.

10.3. Randomised category discounts (stamp 5)

At stamp 5 of each cycle — that is, on every fifth qualifying drink whose count ends in 5 — you receive a discount off a randomly assigned category. Two separate things decide what you get, and it's worth being clear about which is which:

  • The category is random — drawn when the stamp is earned, with an equal chance for each of the six categories below. No category is weighted more heavily than another, and the draw happens once: it is never re-rolled afterwards.
  • The Rand value is not random — it's fixed by how many qualifying drinks you've bought in total (see 10.4). The draw never decides how much your discount is worth.

We may designate specific products within a category as participating or non-participating for a given promotion or period; we'll clearly communicate any such exclusions to members. We don't guarantee that every product in a category is always available — see 10.6 if the item you wanted is off the shelf.

10.4. Discount value

How much a discount is worth depends only on your total number of qualifying drinks at the moment it's issued:

  • Under 50 qualifying drinks: R5 off the drawn category.
  • 50 or more qualifying drinks: R10 off the drawn category.

Once issued, a discount keeps the value it was issued at — passing 50 drinks does not top up a discount you already hold. Each reward clearly shows its Rand value and the category it applies to.

10.5. Free beverage reward (stamp 10)

After 9 qualifying stamps, your 10th qualifying beverage is free. You can choose it from:

  • Hot beverages — coffee, flavoured lattes, chai, matcha, assorted teas — in Small, Medium, or Grande.
  • Cold beverages — cold coffee, flavoured cold drinks, Freezos, matcha, frozen yoghurt — in Small or Large.
  • Latte of the Month.

The free-beverage reward applies only to the products and sizes listed above.

A free beverage does not itself earn a stamp. Only paid qualifying drinks do. In practice this means: you buy your 9th drink and it stamps as normal, the 10th stamp lands automatically and becomes a free beverage sitting in your account, and your counter then starts again from 1 on your next paid drink. Redeeming the free beverage doesn't add to the count — otherwise a free drink would earn its way toward the next free drink.

10.6. Reward expiry, extensions & accumulation

The two reward types behave differently on purpose, and this is the single most important thing to understand about the programme:

  • Discounts start counting down the moment you earn them. A discount (stamp 5) is collected into your account automatically — there's nothing to accept — and is valid for 7 calendar days from issue. You don't need to do anything to activate it, and you can't pause it. Once the 7 days pass it expires on its own and can't be redeemed, exchanged for cash, or transferred.
  • Free beverages sit in your inventory and wait. A free beverage (stamp 10) is banked in your account until you choose to claim it, and stays valid for 12 months from issue. They accumulate — you can hold several at once. You may redeem a minimum of one per transaction and a maximum of three per day. They have no cash value.
  • Merchandise rewards also bank in your inventory until claimed, and don't tick down.

If the product you wanted isn't available. If a discount you're holding applies to a category and the specific item you wanted is temporarily out of stock, you can either use the discount on something else in that category, or ask a staff member to extend it. On request, staff can add a further 7 calendar days to that discount at the counter, so an out-of-stock shelf doesn't cost you a reward you've already earned. Extensions are arranged in person and at our discretion, and are limited to one extension per discount — after that, please speak to a manager.

These validity periods apply because loyalty rewards are earned, not purchased — membership is free and you don't pay anything to join, to earn stamps, or to hold a reward. A stamp, discount, or free beverage is not a prepaid voucher or a good you've bought from us; it's a benefit we choose to extend to you in exchange for your custom, on the terms set out here. Because no money changes hands for the reward itself, the 7-day and 12-month validity windows above apply as stated, regardless of how much you've spent to earn them.

10.7. Merchandise rewards

Reaching certain drink counts also unlocks merchandise — in addition to, not instead of, whatever that stamp would normally give you. Each of these lands on a stamp 5, so you receive both the merchandise item and that stamp's discount together.

Merchandise rewards are subject to stock availability. Where a specific item is unavailable, we may provide a comparable alternative of equal or greater value.

10.8. Redeeming a reward

To redeem, show the reward's QR code (or read out its 4-digit code) to a staff member at the till or collection point — they'll confirm it and mark it redeemed on the system. Your live progress, your current rewards, and how long each one has left are all shown on the Pase de Café page.

10.9. If you lose access to your account

Your stamps and rewards live on your account, not on a card, so losing a phone doesn't lose your progress — just sign in again on another device.

If you can no longer sign in at all (for example you've lost access to the email address on the account), contact us using the details in section 15. We'll ask you to verify your identity through the email address or phone number registered on the account using a one-time code before we do anything. Once you're verified, we'll move your remaining balance to your recovered account and permanently lock the old one.

  • Staff cannot move stamps or rewards between accounts on a verbal request alone — verification is always required. This protects your balance as much as it protects us.
  • Rewards that were already redeemed are not reissued.
  • Every transfer is logged against the staff member who approved it.
  • If you believe someone else has used your account, tell us as soon as possible so we can lock it.

10.10. If something goes wrong — disputes

If you believe that a stamp, reward or redemption has been recorded incorrectly, please raise the matter with us in store. A staff member will create a dispute request on the system. You may be asked to provide an email address so that we can communicate the outcome to you, and the staff member handling the request will record their details on the request.

Incorrect stamps — If a stamp has been incorrectly added, omitted or recorded, for example because of a scanning or processing error, you and the staff member will record the relevant details and the proposed correction. Corrections may be subject to management verification before being applied.

Problems with rewards or redemptions — If a reward or redemption has not been processed as intended, you may identify the relevant reward from your redemption history and explain the issue. Depending on the circumstances, we may correct the transaction, reinstate the relevant loyalty award, provide another appropriate remedy, or escalate the matter to a manager. Where a refund or other remedy is required under applicable law, that remedy will not be excluded by this dispute process.

We will communicate the outcome using the contact details provided with the dispute request.

Unless applicable law requires otherwise, submitting a dispute does not automatically extend the validity period of an unrelated reward or loyalty award.

Nothing in this dispute process limits, excludes or waives any right or remedy that you may have under the Consumer Protection Act or any other applicable law.

Our dispute-handling process

In your own words, set out the three steps below so members know exactly what to expect: how a member reports an error → how we investigate it → how we correct ordinary programme errors.

10.11. If the programme ends

If we discontinue the Loyalty Programme, rewards you've already validly earned remain redeemable — for as long as the stock backing them lasts, and subject to their normal expiry dates. We'll give notice under the amendment clause below, and we won't cancel earned rewards simply because the programme is closing. Once the relevant stock is exhausted, the reward can no longer be redeemed and has no cash value.

10.12. General conditions

  • It's free: joining, earning, and redeeming cost nothing extra — there are no fees to join or to use the programme.
  • One account per person. Stamps, discounts, and rewards are personal to your account — they can't be sold, transferred, pooled across accounts, or exchanged for cash (unless the law requires it), and may only be redeemed against eligible participating products.
  • Refunded purchases lose their stamp. If a qualifying purchase is refunded or reversed, the stamp it earned is removed. If that stamp had already triggered a reward and the reward is still unredeemed, the reward is removed with it.
  • Every paid qualifying drink stamps, including several bought in one transaction — four drinks in one order earn four stamps. Promotional and already-discounted drinks still earn a stamp, including a drink bought using one of your own loyalty discounts, as long as you paid something for it. The only drink that doesn't stamp is one that cost you nothing — a free beverage reward (see 10.5).
  • Discounts don't stack. One discount per transaction, and discounts can't be combined with another promotion on the same item unless we say otherwise.
  • Rewards and free items are subject to availability and offered while stocks last.
  • Fair use: stamps and rewards are void if obtained through fraud, abuse, or manipulation of the loyalty system, and we may suspend or close an account where there's reasonable evidence of that.

Con Leche may amend the Loyalty Programme from time to time. Any material amendment affecting the earning, validity, or redemption of loyalty rewards will be communicated to members — with at least 20 business days' written notice (by email and on this page) — before it takes effect. Amendments will not retrospectively remove or reduce rewards that have already been validly earned, except where required by law or in cases of fraud or abuse.

10.13. Phone-number tracking (no account required)

If you'd rather not create an account yet, we can still track your drinks — using nothing but your phone number.

  • What we store: just your phone number and a running count of qualifying drinks. No name, no email, no login, and it isn't linked to anything else about you.
  • The free beverage still applies. Your 10th qualifying drink (and every 10th after that) is free, same as 10.5 — but because there's no account to bank it on, it's applied immediately, comped into the order you're buying it in, on the spot.
  • Other rewards don't accrue this way. The stamp 5 discount, merchandise milestones, and everything else in this section 10 require a registered account to be issued and collected — phone tracking on its own only carries the free-beverage stamp.
  • Signing up later carries your count over. If you register an account using the same phone number, your tracked drinks are added to your new account, and any stamp 5 discounts, merchandise, or other rewards you'd have earned along the way are issued on your account at that point — backdated, in effect, to when you'd have earned them. Free beverages you already received in-store under phone tracking are not reissued a second time.
  • Your phone-tracked count isn't erased by signing up. If the same number is used again for phone tracking afterwards, it simply keeps counting from where it left off, separately from your account.
  • Phone-number tracking is offered for convenience and remains subject to the fair-use terms in 10.12.

11. Limitation of liability

  • Food is intended for prompt consumption. Once collected, its quality and safety depend on how it's stored and handled — we're not responsible for a drop in quality or safety where consumption is delayed after collection.
  • To the fullest extent the law allows, we're not liable for indirect, incidental, or consequential losses arising from using this website, the app, or the service.
  • The site is provided “as is”. We work to keep it available and accurate but can't guarantee it will always be error-free or uninterrupted.
  • Nothing in these terms excludes liability that can't lawfully be excluded — including your rights under the Consumer Protection Act.

12. Intellectual property

The Con Leche name, logo, menu descriptions, photos, and site content belong to us and may not be copied or reused without our permission.

13. Governing law & privacy

These terms are governed by the laws of the Republic of South Africa, and any dispute falls under the jurisdiction of the South African courts. We handle your personal information — including your name, phone number, and payment data — in line with POPIA and our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. The current version is always the one published on this page, with the “last updated” date at the top. For material changes to the loyalty programme, the 20-business-day notice above applies.
